According to the Provincial Consumer Council, since last year, many complaints have been received from the elderly due to health care consumption. For example,in April last year,a couple bought 200000 yuan of health care products at a"workstation"that claimed to be able to treat carotid plaque, but later found that they had no effect at all;In December last year,a 70 year old consumer in Guangzhou experienced severe abdominal pain after receiving massage services in a physiotherapy shop.He went to the doctor the next day and found a rib fracture
The Provincial Consumer Council pointed out that the"silver economy"shows a trend of quality, diversification and personalization. The consumption mode of many elderly people has gradually changed from survival type to enjoyment type. The demand for health care services such as massage, moxibustion foot bath, beauty ear picking and various health care products is increasing. However,at the same time, the consumption disputes caused by many business routines, lack of relevant knowledge and weak awareness of rights protection of the elderly are also increasing.
In this regard, the Provincial Consumer Council reminded elderly consumers that they should first look at the efficacy publicity rationally. If you feel unwell, you should go to a regular medical institution for examination and treatment in time. You should correctly view the role of health care and the efficacy of health products, which can not be used as a way to treat physical diseases.
Secondly, recognize your physical condition. When the elderly choose health care services, they should pay special attention to those in line with their own physical conditions, and try to choose more moderate service items to avoid physical injury caused by improper health care.
When purchasing health care services and health products,it is best to consult your family. We should comprehensively consider our own actual situation and needs, try to avoid buying too many projects or paying large fees at one time, and achieve on-demand purchase and rational consumption.
In addition, during health care consumption,do not disclose your ID card information, family members, economic income, physical condition and other information to salespeople at will. When finding that their rights and interests have been infringed, they should immediately inform their children or family members and report to the relevant departments in time. They can protect their legitimate rights and interests by complaining to the local consumer committee or calling 12315 and 12345 hotlines.
At the same time, the provincial council also suggested that children and family members should care more about and accompany the elderly at home, actively guide the elderly to view the role and efficacy of health care services and health products scientifically and rationally, pay attention to the psychological and physical health status of the elderly, and advocate a scientific and effective way of health preservation.
Case:spent 14280 yuan to buy a water dispenser and found cheated
On March 26,2022,the Guangdong Provincial Consumer Council received a complaint from Miss Huang, saying that a salesperson had come to her parents in their 80s for many days to sell a high-priced water dispenser worth 14280 yuan, claiming that drinking the water from the dispenser can treat a variety of diseases.Taking advantage of the absence of the elderly's children, the salesperson booed the elderly, made use of the elderly's desire for health, and took various means such as false publicity to induce the elderly to buy products. After finding that her parents were cheated,Miss Huang went to the store to communicate with the salesperson for a refund. After being rejected, she went to the Provincial Consumer Council for help.
After receiving the complaint, the Consumer Council immediately contacted the person in charge of the business to communicate and understand the situation, and asked the other party to solve the complaint as soon as possible. After that, the merchant called back and said that it had negotiated a settlement with consumers. After verification with Miss Huang, the Consumer Council confirmed that the two sides reached an agreement through consultation. At present, the goods have been returned and refunded, and the complaint mediation has been successful.
The Provincial Consumer Council pointed out that the salesperson in this case should fulfill the obligation to inform the true information according to law,but he claimed that the water dispenser involved in the case can treat a variety of diseases, and then eliminate the vigilance of the elderly by playing family cards to induce them to buy.It is suspected of false publicity, which infringed on the elderly's right to know and fair trade. At the same time, according to the provisions of articles 6 and 16 of the measures for punishment of acts infringing on the rights and interests of consumers,a business operator selling goods or services by means of false or misleading commodity descriptions, commodity standards, physical samples, etc.is a fraud. The salesperson's behavior in this case has been suspected of fraud. If the consumer can fully prove it,he can claim punitive compensation in accordance with Article 55 of the consumer rights and interests protection law.
